1. Who we are
Simfiy ("Simfiy", "we", "us", "our") operates an online store that resells embedded SIM ("eSIM") profiles for mobile data and, where offered, real-number voice and SMS connectivity. The underlying connectivity is provided by third-party mobile network operators and aggregators. Simfiy is a reseller and is not itself a licensed mobile carrier.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, and able to enter into a binding contract to use Simfiy. By purchasing, you confirm that the information you provide is accurate and that you are not barred from receiving our services under any applicable law or sanctions program.
3. Your account
Some features require an account tied to your email address. You are responsible for keeping your account credentials and any eSIM activation details (including QR codes) confidential, and for all activity that occurs under your account. Notify us promptly if you suspect unauthorized use. eSIM QR codes are single-use credentials — anyone who obtains your QR code may be able to install your plan.
4. Nature of an eSIM and device requirements
An eSIM is a digital product. We do not ship any physical SIM card. To use a Simfiy eSIM, your device must:
- be eSIM-compatible (most phones released from 2018 onward support eSIM — see our compatibility guide), and
- be carrier-unlocked, so it is not restricted to a single network operator.
It is your responsibility to confirm your device meets these requirements before purchase. Because an eSIM is delivered and installed instantly, refunds for an installed eSIM are limited — see our Refund Policy.
5. Pricing and taxes
Prices are shown at checkout and are charged in the displayed currency. We accept payment by card, USDT cryptocurrency, and Telegram Stars. Card payments are processed by Stripe and crypto payments by NOWPayments; Simfiy never stores your full card details. You are responsible for any applicable taxes, duties, bank fees, or currency-conversion charges levied by your payment provider. Cryptocurrency amounts are calculated at the prevailing exchange rate at the time of payment and are subject to network confirmation.
6. Delivery
eSIMs are delivered digitally. Once your payment is confirmed, your eSIM QR code and installation instructions appear in your account and are sent to your email, typically within seconds. You acknowledge that, by accepting instant delivery of a digital product, you may lose statutory rights of withdrawal that would otherwise apply to undelivered goods.
7. Acceptable use
You agree to use Simfiy services lawfully and only for ordinary personal or business connectivity. You must not:
- resell, sub-let, or commercially redistribute connectivity without our written permission;
- use the service for spam, fraud, unlawful interception, or to send unsolicited bulk messages;
- use automated systems to generate abusive traffic, or otherwise place an unreasonable load on a network operator;
- violate any applicable law or the acceptable-use rules of the underlying network operator.
We may suspend or terminate access, without refund, where we reasonably believe these rules have been breached.
8. Third-party network operators
Coverage, speed, latency, and the availability of voice and SMS depend on third-party mobile network operators and their roaming partners. Network performance varies by location, device, local regulation, and network congestion, and is outside Simfiy's direct control. Some operators may apply fair-use limits, throttle speeds after a data threshold, or restrict certain services such as tethering or VoIP. 9. Disclaimers and limitation of liability
To the maximum extent permitted by law, Simfiy services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose and uninterrupted availability. We do not warrant that connectivity will be free of interruptions or errors.
To the maximum extent permitted by law, Simfiy is not liable for indirect, incidental, special, or consequential damages, or for loss of profits, data, or business, arising from your use of the service. Our total aggregate liability for any claim is limited to the amount you paid for the eSIM giving rise to the claim. Nothing in these terms excludes liability that cannot lawfully be excluded.
10. Governing law
These terms are governed by the laws of [jurisdiction], and the courts of [jurisdiction] have exclusive jurisdiction over any dispute, without regard to conflict-of-law principles. Where mandatory consumer-protection law in your country of residence grants you additional rights, those rights are unaffected.
11. Changes to these terms
We may update these terms from time to time. When we do, we will revise the "Last updated" date above and, for material changes, take reasonable steps to notify you. Your continued use of Simfiy after a change takes effect constitutes acceptance of the updated terms.
