Purchase, Cancellation and Refund Policy
This Purchase, Cancellation and Refund Policy (“Purchase Policy”) is a binding agreement between you (the “User”, “you” or “your”) and simfiy (the “Company”, “we”, “us” or “our”), concerning your access to and use of simfiy’s Services via the simfiy website and other linked channels, mobile websites or applications (the “Platform”). Please read this Policy carefully as it contains important information and affects your legal rights.
simfiy is delivered to you electronically and instantly. It cannot be returned after delivery. The payment is made instantly via credit card, mobile payment or in-app purchase. The Application will be deemed to have fulfilled its performance, and its responsibility will end, when the product is delivered electronically. In disputes that may arise regarding this contract, UK courts are authorised and the applicable law is English law.
How to Purchase
You can make a purchase via the web or by following the instructions in a third-party app store on which the App is made available, such as the Apple App Store and Google Play Store (an “App Store”). Please refer to the App Store terms for the relevant cancellation period and more information.
Purchase Period
Purchases may be carried out as one-off purchases, pay as you go (where the fee is deducted from your io balance wallet), or on a recurring subscription basis. For subscription-based services, the period will automatically renew on the day it expires for another period of the same length, and you will be charged in advance on the renewal date unless you cancel beforehand. We may change the purchase-period lengths we offer, but we will not change the length of your purchase period while it is active.
Purchase Price Change
We reserve the right to change our pricing terms at any time. Changes will not apply retroactively and will only apply to renewals after the date of such change. If you do not agree to a subscription fee increase, you can cancel your subscription before your next subscription period starts.
Suspension for Non-payment
We and/or the relevant App Store may immediately suspend your access to the App if your purchase is not paid, until the full amount has been paid. If any amount remains unpaid following our notice to you, we may end your rights under this Purchase Policy. All payments made are non-refundable and non-transferable except as expressly provided in this document.
Cancellation
You may cancel your purchase or cancel the renewal of your subscription at any time. You will not receive a refund for fees already paid for your current purchase period, and you will continue to receive the purchased Service features until the end of that period. Please note that deleting the application does not cancel or end your purchase.
Refunds
You may be eligible for a refund only from the destination of your transaction (App Store).
Apple App Store — to request a refund:
- Sign in to reportaproblem.apple.com;
- Tap or click “I’d like to”, then choose “Request a refund”;
- Choose the reason for the refund, then choose Next;
- Choose the app, purchase, or other item, then choose Submit.
Google Play — to request a refund:
- Go to play.google.com and click your profile icon at the top right;
- Select Payments & Purchases, then Budget & order history;
- Find the order you want to return;
- Select “Request a refund or report a problem” and choose the option that describes your situation;
- Complete the form and note that you’d like a refund. You’ll receive an email with a refund decision.
