Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you (the “User”, “you” or “your”) and simfiy (the “Company”, “we”, “us” or “our”), concerning your access to and use of simfiy’s Services via the simfiy website, related features and services, and other linked channels, mobile websites or applications (collectively, the “Platform”).
Please read these Terms carefully as they contain important information and affect your legal rights. By accessing the Platform, using the Services or clicking “Agree”, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you should immediately discontinue using the Platform and Services. If you have any questions, contact us at support@simfiy.com.
Description of Services and Fees
simfiy enables you to purchase, activate, download, and manage prepaid mobile data plans delivered via embedded SIM (eSIM) technology through our Platform. Such plans may be offered directly by simfiy or through authorised third-party carriers. To use the Service, you must ensure that your device is carrier-unlocked, supports eSIM functionality, and is compatible with the Service. You are solely responsible for the activation, installation, and provisioning of the eSIM. simfiy disclaims all liability for activation failures, device restrictions, or issues arising from unsupported devices. The Service is provided on an “as-is” and “as-available” basis. simfiy does not provide voice calling or SMS messaging capabilities.
Your Representations and Warranties
- You must be at least eighteen (18) years old;
- You possess the authority to bind yourself or the entity on whose behalf you act;
- Your use of simfiy will comply with all applicable laws, regulations and industry standards;
- You will not use simfiy for any unlawful, abusive, fraudulent or unauthorised purpose;
- All information you provide is true, accurate, complete and current; and
- You will not infringe any intellectual property, privacy or other proprietary rights.
simfiy reserves the right to suspend or terminate your access and delete your account if you breach any of these representations or are determined to be ineligible.
Purchase, Payment Models and Activation
You may complete your purchase through one of the following models: Pay As You Go, Ready Package, or Recurring Subscription. All fees are charged at the time of transaction using your selected payment method. You authorise simfiy and its payment processors to charge all applicable fees, including taxes, duties and surcharges. simfiy accepts major credit/debit cards, digital wallets, and Platform billing options. simfiy does not store payment credentials; all financial data is processed and stored exclusively by licensed third-party payment service providers. You will be presented with a complete cost breakdown, inclusive of VAT and applicable surcharges, before confirming a transaction.
Refunds, Renewals, and Cancellations
If you purchase directly through our website or via a simfiy-approved payment method, all sales are final once the eSIM has been provisioned. Except where required by local law, we do not offer refunds or credits for unused data, expired plans, or partial billing periods. Refund requests for purchases made via mobile platforms such as Apple and Google are governed solely by that application’s refund policy. Subscriptions automatically renew unless cancelled before the renewal date; cancellations take effect at the end of the current term, and prorated refunds will not be issued.
Registration, Activation and Compatibility
You may be required to register for an account and provide information such as your name, email address and mobile number. You are responsible for safeguarding your credentials and for all activity conducted under your account. After purchasing a plan, you must download, install and activate the eSIM on a carrier-unlocked, eSIM-compatible device; a stable internet connection is required for activation. It is solely your responsibility to ensure your device meets all technical specifications, and you are responsible for any taxes, duties or levies imposed in connection with your purchase.
Termination
The licence granted to you is effective until terminated. simfiy may modify, suspend, or discontinue all or any part of the Platform or Services at its sole discretion, and may terminate your access immediately for any reason, including breach of these Terms. You may terminate your licence at any time by submitting a cancellation request and removing the application from your devices. Upon termination, all rights granted to you cease immediately.
Code of Conduct
The Services are provided for personal, non-commercial, non-exclusive, non-transferable use only. You shall not, among other things:
- Use the Platform against any applicable laws;
- Use the Services to support or engage in illegal activities including fraud, money laundering or terrorist activities;
- Disrupt or obstruct the provision of Services to other users;
- Access without authorisation any simfiy systems or content;
- Make any commercial use of the Services or develop third-party applications benefiting from them;
- Copy, decompile, disassemble or reverse engineer any part of the Platform;
- Use any scraper, bot, or automated means to access the Platform or upload harmful software; or
- Use the Platform to market, advertise or offer to sell goods or services.
Risk Disclosure
Access to eSIM provisioning and mobile data services may degrade, fail, or become temporarily unavailable during network congestion, high demand, maintenance, or carrier-side restrictions. simfiy relies on third-party carriers and network operators to deliver connectivity, and neither simfiy nor its partners guarantee continuous service. You will see your purchased eSIM under the “My SIMs” tab and receive a confirmation email after purchase; all installation information is available only in your simfiy account.
Indemnification
You agree to defend, indemnify and hold harmless simfiy, its parent and subsidiary companies, and their respective officers, directors, employees, agents, partners and licensors from any losses, liabilities, damages, costs and expenses arising out of any third-party claim relating to your breach of these Terms, your use of the Service, your violation of applicable law or third-party rights, or any harmful or illicit conduct.
Intellectual Property Rights
The Platform and all content therein — including signs, text, graphics, software, source code, databases, designs, audio, video, trademarks, service marks and logos (the “simfiy IP”) — are owned by, licensed to, or controlled by us, and are protected by intellectual property rights. You are granted a limited right to access and use the simfiy IP in accordance with these Terms. Copying, reproducing, republishing, distributing, selling, reverse engineering or otherwise exploiting any part of the Platform without our express prior written permission is strictly prohibited.
Disclaimer of Warranties
Your use of our Services is at your sole risk. simfiy is provided on an “as-is” and “as-available” basis, and to the fullest extent permitted by law, simfiy and its affiliates expressly disclaim all warranties, whether express, implied, statutory or otherwise, including any warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, security, availability, or uninterrupted operation.
Limitation of Liability
In no event shall simfiy or its affiliates be liable for any indirect, incidental, special, punitive, or consequential damages, including lost profits, data loss, or loss of goodwill. simfiy’s total aggregate liability for any claims shall not exceed the greater of the total fees actually paid by you in the one (1) month preceding the claim, or five hundred U.S. dollars. These limitations do not apply to liability that cannot be limited or excluded by applicable law.
Applicable Law
These Terms and your use of our Services are governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction over any disputes.
Force Majeure, Amendment and Severability
simfiy shall not be liable for any loss arising from events beyond its reasonable control (“Force Majeure”), including natural disasters, war, labour disputes, government action, or infrastructure failures. We may amend these Terms at any time, with the latest version published on the Platform applying to all Users. If any clause is deemed invalid or unenforceable, the remainder of these Terms shall remain in full force and effect.
Language and Translation
These Terms are originally drafted in English. Any translation is provided solely for convenience, and in the event of any conflict, the English version shall govern and prevail.
